Abstract:
The new rules for consumer alternative dispute resolution (ADR) and online dispute resolution (ODR), the ADR Directive and the ODR Regulation, were introduced with an optimistic narrative based on the consumers ’ , and businesses ’ , desire to engage in non-litigious redress actions. Expert, impartial and professional schemes will, as a consequence of the introduction of the new measures, provide new standards of access to justice, provide a cheap and speedy remedy for consumer disputes, improve market efficiency and reduce consumer detriment. This chapter critically reviews the substance of this optimistic narrative.
