Abstract: | There is a tension that can be identified with a comparison of the optimistic claims associated with the 2011 proposals for new EU ADR/ODR legislation and the empirical data available in Eurobarometer surveys that suggests consumer engagement with such schemes is both limited and subject to geographic cultural diversity. Now enacted as legislation, the ADR/ODR provisions are better perceived as belonging to a broader programme of procedural law development and the Europeanisation of private law remedies. |
